TERMS AND CONDITIONS

 

 

The owner of the online store mammucouture.com (hereinafter the online store) is MAMMU COUTURE OÜ (registration code 12129130), located at Liivalaia 32, Tallinn 10138, Estonia.


 

Validity of the sales contract, information about the product and price

The terms of sale apply to the purchase of goods from the online store between any person and MAMMU COUTURE OÜ (hereinafter the owner of the online store). In addition to all the conditions here, all other legal acts of the Republic of Estonia must also be applied to the regulation of purchases from the online store.

 

The owner of the online store has the right to change and supplement the conditions unilaterally by publishing new conditions. If the customer placed an order before the changes to the terms and conditions came into force, the legal relationship between the customer and the shop owner shall be subject to the terms and conditions valid at the time the order was placed, unless the law or these terms and conditions stipulate otherwise.

 

The prices of the products sold in the online store are indicated next to the products. Shipping costs are added to the price. All prices are shown in euros and include all applicable taxes including VAT.

 

Postage costs depend on the buyer's location and delivery method. The shipping costs of the goods are paid by the buyer, whose corresponding price information is displayed next to the shipping method.

 

Product information is provided with the product in the online store.

 

Submitting an order

To order the goods, you must add the desired products to the shopping cart. To complete the order, you must fill in the required data fields and select the appropriate method of product delivery. 

 

If you have an existing discount code, enter it in the corresponding field (discount code) to receive a discount on the order price. The discount applies only to the products and does not affect the postage.

 

Before making the payment, the buyer is obliged to ensure that the data entered in the order are correct and correspond to the actual will of the buyer. The amount of the fee is then displayed on the screen, which can be paid via a bank link or other payment solution.

 

After completing the order and payment, the buyer will be sent an e-mail with the purchase invoice.

The contract enters into force after the amount to be paid is transferred to the bank account of the owner of the online store.

 

If the owner of the online store cannot deliver the ordered goods, the buyer will be notified as soon as possible, and the amount paid (including the shipping cost) will be refunded as soon as possible, but no later than within 14 days from the notification.


 

Payment

To purchase goods, the purchase price and postage must be paid in advance. Payment is made in the relevant payment environment outside the online store. The online store owner does not have access to the buyer's credit card and bank account information.

 

Shipping

The goods are sent to the following countries: members of the EEA (European Economic Area) and outside the EEA. All shipments are carried out by third-party logistics - ITELLA ESTONIA OÜ (registration code 10891224) and AS Eesti Post (registration code 10328799).

 

The buyer pays the shipping costs, the corresponding price information of which is displayed next to the shipping method. The buyer chooses the appropriate method of shipping and receiving the goods, which are as follows:

 

  • parcel machine

  • courier

 

If the buyer has decided to order the goods to a parcel machine, the goods will be delivered to the parcel machine specified by the buyer. The buyer receives an SMS notification about this, which is sent to the number indicated by the buyer along with a unique code that ensures access to the goods in the parcel machine. The owner of the online store is not responsible for damages caused to the customer due to reasons not related to the owner of the online store and caused by third parties acquiring the unique code of the parcel machine and accessing the goods.

 

If the buyer has decided to order the goods by courier, the goods will be delivered to the address specified by the buyer. Before delivery, the courier service provider agrees the delivery time with the buyer.

 

All shipments within Estonia generally arrive at the destination specified by the buyer within 1-3 working days after the sales contract enters into force. All shipments arrive within 7 calendar days within the EEA and 14 calendar days outside the EEA.

In exceptional cases, the owner of the online store has the right to deliver the goods within 45 calendar days.

 

Upon receipt of the goods, the customer undertakes to carefully open the packaging of the product without damaging the packaging and the products. If the customer has damaged the packaging due to carelessness, i.e. it was possible to open the packaging of the product without damaging it, the owner of the online store has the right to demand compensation for the damage caused when returning the goods. If the product packaging cannot be opened without breaking, the customer is not responsible for the damaged packaging.

 

Return policy

After receiving the order, the buyer has the right to withdraw from the contract with the online store within 14 days.

 

Products purchased by a legal person/corporation cannot be returned.

 

In order to use the 14-day right of return, the ordered goods must not be used in any other way than is necessary to make sure of the features, characteristics and functioning of the goods in a way that is allowed for testing the goods in a physical store.

 

If the goods have been used for purposes other than what is necessary to verify the features, characteristics and functioning of the goods, or if they show signs of use or wear, the online store has the right to reduce the refundable fee according to the decrease in the value of the goods.

 

In order to return the goods, a statement of withdrawal from the purchase of the goods must be submitted and sent to the e-mail address info@mammucouture.com within 14 days of receiving the goods at the latest.

 

The cost of returning the goods is paid by the buyer, unless the reason for the return lies in the fact that the item to be returned does not correspond to what was ordered (e.g. a wrong or defective item).

 

The buyer must return the goods within 14 days after submitting the withdrawal statement or provide evidence that the buyer handed over the goods to the carrier within the aforementioned period.

 

Upon receiving the returned goods, the online store will return to the buyer immediately, but no later than 14 days after receiving the withdrawal, all fees received from the buyer under the contract.

 

The online store has the right to deduct the shipping costs from the returned payment in proportion to the returned goods if the buyer loses the right to free shipping ("free shipping"). The buyer loses the right to free delivery ("free shipping") if the goods are partially returned and the final amount paid is less than the amount that guarantees free shipping ("free shipping").

The online store may refuse to issue refunds until it has received the item that is the subject of the contract or until the buyer has provided evidence that it has returned the item, whichever occurs first.

 

If the buyer has explicitly chosen a delivery method other than the cheapest usual delivery method offered by the online store, the online store does not have to refund the cost to the consumer that exceeds the cost associated with the usual delivery method.

 

The online store has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the goods in the online store is marked significantly below the market price of the goods due to an error.

The right to file a claim

The online store is responsible for the non-compliance of the goods sold to the buyer with the contractual conditions or defects that already existed at the time of delivery and appear within two years from the handing over of the goods to the buyer. Within the first six months from the transfer of the matter, it is assumed that the deficiency already existed at the time of the transfer of the matter. It is the online store's responsibility to refute the corresponding assumption.

 

The buyer has the right to contact the online store within two months from the appearance of the defect by e-mail info@mammucouture.com.

 

The online store is not responsible for defects that have occurred after the goods have been handed over to the buyer.

 

The online store is not responsible for defects or damages resulting from improper use of the goods.

 

If the goods purchased from the online store have defects for which the online store is responsible, the online store will repair or replace the defective goods. If it is not possible to repair or replace the goods, the online store will return all fees associated with the sales contract to the buyer.

 

The online store responds to the consumer's complaint in writing or in a form that enables written reproduction within 15 days.

 

 

Force Majeure

The owner of the online store is not responsible for damages caused to the customer or delay in the delivery of the product, if the delay in the delivery of the product is due to a circumstance that the owner of the online store could not influence and which the owner of the online store could not foresee.


 

Direct marketing and processing of personal data

The online store uses the personal data entered by the buyer (including name, phone number, address, e-mail address, bank details) only to process the order and send the goods to the buyer. The online store transmits personal data to companies providing transport services in order to deliver the goods.

 

The online store sends newsletters and offers to the buyer's e-mail address only if the buyer has expressed hers/his desire to do so by entering an e-mail address on the website and has indicated hers/his wish to receive direct mail notifications.

 

The buyer can opt out of the offers and newsletters sent to e-mail at any time by notifying us by e-mail or by following the instructions in the e-mail containing the offers. 


 

Solving complaints

All complaints made by the buyer about the online store must be sent to the e-mail address info@mammucouture.com.

 

If the buyer and the online store cannot resolve the dispute by agreement, the buyer can appeal to the Consumer Disputes Committee. The competence of the Consumer Disputes Committee is to resolve disputes arising from the contract concluded between the buyer and the online store. Review of the buyer's complaint by the commission is free of charge. The buyer can turn to the platform for resolving consumer disputes of the European Union.


 

The owner of the online store assumes that the customer has understood and agreed to the current Terms of Use and Privacy Policy before placing an order or making a purchase.
